One
of the most common questions Union Leaders and Stewards hear is: can I file a
grievance and how?
Oftentimes
members are not aware they can file a grievance. Or they would like to file a
grievance - but are afraid of retaliation from management. There is no magic
answer - but your Union is here to help. Hopefully, this information will
assist Local 189 members in determining what options are available to them
through the Union.
What
Are My Options?
There
are three primary options available to the Union in fighting for our members
rights.
Grievances
involving Contract interpretation and Discipline are the most common.
Discipline is based On Just Cause. Unfair Labor Practices differ in
that they protect Union members from coercion, intimidation and threats
from the employer.
Your
First Step...
The
first step you should take is read and know your contract.
Knowing your rights under the collective bargaining
agreement (contract) will help you determine if you have a valid grievance.
Always remember your Union Steward is your most
important source of information.
Your
Second Step ...
Call
your Union Steward immediately!!!
Your
success in filing a grievance is dependent upon your timely contacting
of your Steward.
The
AFCSME system is based on a strong Steward network. If you cannot locate a
Steward call your Vice President (Chapter Chair) or the Chief Steward.
Your
Third Step ...
Prepare
to meet with your Steward by writing down as many pertinent facts as possible.
Write down a brief two sentence summary of what happened.
Ask yourself this question: Did the employer
violate the collective bargaining agreement and how did this occur? And, if so
what remedy would I like to see?
Next make a list of all
witnesses and who were involved. Lastly, write down in chronological order all of the events even
if they seem trivial to you.
What
Is A Grievance?
Simply
stated a grievance is a violation of the contract!
It
is your Stewards job to decide what contract rights have been violated
and to determine if a grievance exists. Contract interpretation is
often hardest to prove.
When
Is Complaint Not A Grievance?
Life
can be unfair. Not all issues are grievances or can be resolved. However, the
Union is always willing to help in any matter. What are some issues that are
